Terms and Conditions for Altitude Himalaya Pty Ltd.

Definitions:

  • “Company”: Altitude Himalaya Pty Ltd.
  • “Participant” or “Client”: Individual booking the tour/travel/trekking services.
  • “Services”: All services provided by the company as described in the itinerary or service description.

Booking and Payments:

  • All bookings should be made 5 days in advance.
  • A deposit of 20% of the total cost is required to confirm the booking.
  • The remaining balance should be paid no later than 15 days before the commencement of the service.

Cancellations and Refunds:

  • Cancellations made 15 days before the start will be refunded 50% of the deposit.
  • Cancellations made within 15 days will not receive a deposit refund.
  • The company reserves the right to cancel any service due to unforeseen circumstances, offering an alternative or full refund.

Insurance:

  • All participants must have personal travel insurance covering medical evacuation, personal accidents, and trip cancellations.
  • The company is not responsible for any losses due to the absence of insurance.

Itinerary Changes:

  • While the company will make every effort to adhere to the advertised itinerary, it reserves the right to change it due to weather, safety concerns, or other uncontrollable events.

Liabilities and Limitations:

  • The company is not liable for any accidents, illnesses, injuries, or losses sustained during the trip.
  • The company is not responsible for any losses due to flight delays, strikes, wars, natural disasters, or events beyond its control.

Health and Fitness:

  • Participants must declare any pre-existing medical conditions and ensure they are medically fit for the journey.
  • The company reserves the right to decline any participant deemed unfit for the trek/tour.

Passports and Visas:

  • It's the client's responsibility to have a valid passport and necessary visas.

Behavior and Conduct:

  • Participants are expected to behave in a respectful and appropriate manner.
  • The company reserves the right to remove any participant whose behavior is deemed disruptive.

Complaints:

  • Any complaints should be addressed directly to the company within 5 days of the service ending.

Environmental Responsibility:

  • Participants are expected to respect local cultures and the environment.
  • Littering, damage to natural habitats, or disrespect to local customs is not acceptable.

Photography and Marketing:

  • The company may take photographs and videos during the service for marketing purposes.
  • If participants do not wish to be photographed, they must inform the company beforehand.

Force Majeure:

  • Neither party shall be held liable for any failure to perform its obligations where such failure is as a result of Acts of Nature, war, strikes, or any other force majeure event.

Governing Law and Jurisdiction:

  • These terms and conditions are governed by the laws of Queensland, Australia.
  • Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of Queensland, Australia courts.

Amendments:

  • The company reserves the right to update these terms and conditions at any time. Clients will be notified of any significant changes.

Acknowledgment

By booking with Altitude Himalaya Pty Ltd., the participant acknowledges that they have read, understood, and agreed to these terms and conditions.
